About These Terms

These Terms & Conditions govern the sale and supply of goods and related services by PV Connections Pty Ltd ABN 49 164 510 543 ("PV Connections", "we", "us" or "our"). They apply to purchases made through our website, by telephone, email, quotation, purchase order, approved trading account or another sales channel accepted by us.

Nothing in these Terms limits any right, guarantee, remedy or liability that cannot lawfully be limited under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law ("ACL") or other applicable legislation.

Acceptance of These Terms

By placing an order, accepting a quotation, using a trading account, instructing us to supply Goods or Services, or accepting Goods supplied by PV Connections, the Customer agrees to these Terms.

"Customer" means the person or entity purchasing Goods or Services. "Goods" means products supplied by PV Connections, "Services" means related services we agree to provide, and "Price" means the amount payable for those Goods or Services.

Anyone ordering on behalf of a business or other organisation represents that they have authority to do so. Any variation to these Terms must be accepted in writing by an authorised representative of PV Connections.

Where more than one person or entity is named as the Customer, each may be jointly and severally responsible for amounts properly payable under the transaction, to the extent permitted by law.

A trading-account Customer must notify PV Connections within a reasonable period of any material change to its business name, ownership, billing details, delivery details or authorised account information.

Goods, Services and Quotations

Goods and Services supplied will be those identified in the applicable quotation, order confirmation, invoice or other written agreement. Quotations remain valid for the period stated and may be revised before acceptance where supplier pricing, availability, freight, taxes or other material circumstances change.

An order is an offer to purchase and may be accepted or declined due to availability, payment issues, pricing or description errors, supply restrictions, suspected fraud or circumstances outside our reasonable control. An order is accepted when confirmed, fulfilled or dispatched by PV Connections.

Custom, specially sourced, made-to-order, labelled, configured or cut-to-length Goods may become binding once work or procurement begins. Customer-requested changes after this point may result in additional charges and revised completion times.

PV Connections may cancel or suspend an accepted order where Goods become unavailable, payment cannot be processed, information cannot be verified, fulfilment becomes unlawful or impracticable, or another material circumstance prevents supply. Any applicable prepaid amount for Goods that cannot be supplied will be refunded or otherwise resolved with the Customer.

Delivery and Collection

PV Connections may deliver Goods to an accepted address or make them available for collection. Delivery charges and arrangements may depend on the Goods, order size, destination and carrier requirements, and orders may be supplied in separate consignments where reasonably necessary.

Dispatch and delivery dates are estimates unless expressly agreed otherwise in writing. Delays may occur because of carriers, suppliers, weather, government restrictions, industrial action, import delays or other circumstances outside our reasonable control, subject to applicable law.

Customers must provide accurate delivery details and reasonable access. Additional freight, storage or redelivery costs resulting from incorrect information or unavailable access may apply. Collection by the Customer or an authorised representative constitutes receipt of the Goods.

Where the Customer requests special freight, insurance or handling arrangements, the Customer is responsible for the associated costs where those costs have been disclosed or agreed.

PV Connections is not responsible for delay or failure to perform caused by events outside its reasonable control, including severe weather, fire, industrial action, transport disruption, government restrictions, supplier interruption or significant supply-chain disruption, subject to applicable law.

Limitation of Liability

Nothing in these Terms limits any liability, consumer guarantee, right or remedy that cannot lawfully be limited. Any limitation stated in these Terms applies only to the maximum extent permitted by applicable law.

PV Connections is not responsible for loss resulting from improper storage, misuse, unauthorised alteration, incorrect installation, failure to follow applicable instructions or use of Goods contrary to legal or product requirements, to the extent permitted by law.

For business transactions where liability may lawfully be limited, PV Connections is not liable for indirect or consequential commercial loss, such as loss of profit, revenue, anticipated savings, business opportunity or business interruption, to the extent permitted by law.

For business transactions where liability may lawfully be limited, PV Connections' aggregate liability arising from the affected Goods or Services will not exceed the amount paid by the Customer for those Goods or Services giving rise to the claim.

This limitation applies only to the extent permitted by law and does not restrict any liability, consumer guarantee, right or remedy that cannot lawfully be limited.

General Terms

If any provision of these Terms is invalid or unenforceable, it will be read down where possible or severed where necessary without affecting the remaining provisions. PV Connections may use manufacturers, freight providers, contractors and other service providers as reasonably necessary to fulfil its obligations.

PV Connections may update these Terms to reflect changes to its products, processes, business practices or applicable law. Revised Terms generally apply to future transactions and do not retrospectively alter an accepted order unless agreed or required by law.

Personal information collected in connection with orders, accounts, payments and enquiries is handled in accordance with the PV Connections Privacy Policy and applicable Australian privacy laws.

Where a business Customer applies for or uses commercial credit, PV Connections may obtain, use or exchange information reasonably required to assess and administer that credit arrangement, subject to applicable privacy and credit-reporting laws and any required consent.

Any additional credit terms, guarantees, reporting permissions or account conditions will be governed by the applicable credit application, account agreement or other written documentation.
